Welcome to wexioStream ("the Service", "the Platform", "we", "us"). These Terms of Service govern your access to and use of our global high-speed file hosting, media delivery, and creator monetization platform. Please read them thoroughly before creating an account or uploading any material.

1. Acceptance of Terms

By accessing or using wexioStream, you agree to be bound by these Terms of Service, our Privacy Policy, and our Acceptable Use Policy. If you do not agree to all of these terms, do not access or use the Service.

We reserve the right to revise or update these terms at our sole discretion. We will notify you of material changes via platform announcements or email notifications. Your continued use of the Service following the posting of updated terms constitutes your binding acceptance of the revisions.

2. Account Eligibility & Security

  • Age Requirement: You must be at least 18 years old (or the age of majority in your jurisdiction) to register an account or participate in creator monetization. The Service is strictly intended for adults.
  • Account Credentials: You are solely responsible for maintaining the confidentiality of your credentials, password, and two-factor authentication tokens. You must notify us immediately at [email protected] if you suspect unauthorized access.
  • One Account Policy: Creators may not operate multiple accounts to circumvent quotas, abuse referral mechanisms, or manipulate platform analytics.

3. Prohibited Content & Zero-Tolerance Violations

You may not upload, host, stream, distribute, or link to any material that:

  • Violates applicable regional, national, or international laws.
  • Infringes upon any patent, trademark, trade secret, copyright, or intellectual property rights of others.
  • Contains Child Sexual Abuse Material (CSAM) or exploitation content. We maintain an absolute zero-tolerance policy for CSAM and immediately report any instances to the National Center for Missing & Exploited Children (NCMEC) and competent law enforcement authorities.
  • Promotes violence, terrorism, hate speech, harassment, or self-harm.
  • Distributes malware, spyware, ransomware, phishing payloads, or deceptive exploits.

We reserve the unconditional right to immediately take down infringing or illegal files and terminate the associated accounts without prior notice.

4. Creator Monetization & Anti-Fraud Rules

wexioStream offers a transparent revenue-sharing program for qualified video and file distribution. Participation in the program is subject to strict traffic integrity standards:

  • Valid Human Views: Earnings are calculated exclusively from legitimate, non-automated views by genuine human audiences interacting with platform media.
  • Strictly Prohibited Traffic: Any attempt to artificially inflate view counts, impressions, or downloads through automated bots, scrapers, headless browsers, datacenter proxies, VPN manipulation, view/click farms, or traffic generation networks is strictly prohibited.
  • Forfeiture of Payouts: Any account identified engaging in fraudulent traffic generation, impression spoofing, or view manipulation will face immediate termination and total forfeiture of all pending and accumulated balances without payout.
  • Audit & Adjustment Rights: We reserve the right to audit traffic metrics, investigate suspicious play sessions, and reverse credited earnings prior to payout approval.
  • Payout Terms: The minimum payout threshold is $20.00 USD. Payout requests are reviewed by our fraud prevention team and processed within seven (7) business days of approval via supported payout gateways or cryptocurrency transfers.

5. Storage Quotas, Bandwidth & Content Lifecycle

  • Free Tier Allowances: Free accounts receive designated cloud storage and bandwidth quotas. To maintain network health, files stored on free accounts with no active downloads or streaming activity for 180 consecutive days may be marked as inactive and scheduled for automated deletion.
  • Premium Tier: Accounts subscribing to verified tiers receive dedicated high-performance storage pools and priority CDN routing per their active plan.
  • Bandwidth Fair Use: We reserve the right to throttle or rate-limit automated requests or anomalous consumption that threatens the stability of our global delivery infrastructure.

6. Copyright & DMCA Compliance

wexioStream complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe your copyrighted work is hosted on our platform without authorization, submit a notice of claimed infringement to our designated copyright agent in accordance with our Copyright Policy and DMCA Guide.

We enforce a strict Repeat Infringer Policy that results in permanent account closure for users found to repeatedly upload unauthorized material.

7. Data Protection & Uploaded Personal Data

When you upload or share media that contains personal data or identifiable depictions of other individuals, you warrant and represent that you have an established lawful basis (such as informed consent) to process and publish that data. You agree to cooperate promptly with any data deletion or access requests forwarded by wexioStream.

8. Limitation of Liability & Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, statutory, or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by applicable law, wexioStream Network Inc., its affiliates, officers, and infrastructure partners will not be liable for any indirect, incidental, punitive, or consequential damages (including loss of data, profits, or goodwill). Our total cumulative liability for any claim arising out of your use of the Service shall not exceed the greater of $50.00 USD or the total amount paid by you to us in the twelve (12) months preceding the incident.

9. Account Termination

We may suspend, disable, or permanently terminate your account at any time for violation of these Terms, suspected security hazards, or fraudulent activity. You may voluntarily terminate your account at any time via your account settings. Upon termination:

  • Your public links and media assets will be unlinked from the global edge cache.
  • You may request an archive export of your eligible personal data within thirty (30) days of closure, subject to our statutory retention obligations.

10. Governing Law, Arbitration & Consumer Rights

These Terms are governed by and construed in accordance with the laws of our operating jurisdiction, without regard to conflict of law principles. Any unresolved disputes arising under these Terms shall be resolved through confidential, binding individual arbitration, and you waive any right to participate in a class action lawsuit.

Statutory Consumer Protections: If you reside in the European Union or the United Kingdom, nothing in these Terms impairs your mandatory rights under local consumer protection legislation, and you may initiate proceedings before competent courts in your jurisdiction of residence.
